AUXCON Terms of Service

1. Acceptance of Terms

By creating an account, browsing content, or using any features of AUXCON, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy. These Terms apply to all users, including creators, collaborators, viewers, and visitors.

2. Eligibility

To use AUXCON, you must:

• Be at least 18 years of age (or the age of majority in your jurisdiction)
• Have the legal capacity to enter into binding agreements
• Not be prohibited from using the Service under applicable law
• Provide accurate and complete registration information

If you are using AUXCON on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

AUXCON reserves the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. User Content

a) Your Content

You retain ownership of content you upload, post, or share on AUXCON ("User Content"), including:

• Videos, images, and audio
• Posts, comments, and descriptions
• Service listings and gear listings
• Profile information and bios

b) License Grant

By posting User Content, you grant AUXCON a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and improving the Service. This license ends when you delete your content or account, except where content has been shared or reposted by others.

c) Content Standards

You agree not to upload or share content that:

• Violates intellectual property rights
• Contains hate speech, harassment, or discrimination
• Includes explicit, violent, or harmful material
• Promotes illegal activities or fraud
• Contains spam, malware, or deceptive links
• Impersonates others or misrepresents your identity

5. Platform Usage Rules

You agree to use AUXCON responsibly and not to:

• Violate any applicable laws or regulations
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to accounts or systems
• Use automated tools (bots, scrapers) without permission
• Engage in misleading, fraudulent, or deceptive practices
• Harass, threaten, or abuse other users
• Circumvent security measures or access controls

6. Services, Transactions & Payments

a) Marketplace Features

AUXCON facilitates connections between creators offering services and gear. AUXCON acts as a platform, not as a party to transactions between users. We do not guarantee the quality, safety, or legality of items or services listed.

b) Payment Processing

Payments are processed by third-party providers. You agree to comply with their terms. AUXCON may charge platform fees or commissions as disclosed at the time of transaction.

c) Disputes

Disputes between users should be resolved directly between the parties. AUXCON may provide support or mediation tools but is not responsible for resolving disputes or issuing refunds, except as required by law.

7. Intellectual Property

All intellectual property rights in the AUXCON platform, including:

• Software, code, and algorithms
• Design, logos, and trademarks
• Platform features and functionality

are owned by AUXCON or its licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.

8. Copyright & DMCA

AUXCON respects intellectual property rights. If you believe content on AUXCON infringes your copyright, please submit a DMCA notice to support@auxcon.app with all required information as specified by the Digital Millennium Copyright Act.

9. Moderation & Enforcement

AUXCON reserves the right to:

• Review, monitor, or remove content at our discretion
• Suspend or terminate accounts for violations
• Investigate suspected violations or illegal activity
• Cooperate with law enforcement as required

We are not obligated to monitor content but may do so to maintain community standards and safety.

10. Disclaimers

AUXCON is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of uninterrupted or error-free operation
• Warranties regarding the accuracy or reliability of content

We do not guarantee that the Service will meet your requirements or be available at all times.

11. Limitation of Liability

To the maximum extent permitted by law, AUXCON and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use or inability to use the Service, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless AUXCON and its affiliates from any claims, losses, liabilities, damages, costs, or expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

13. Termination

You may terminate your account at any time by contacting support or using in-app settings. AUXCON may suspend or terminate your account:

• For violation of these Terms
• For suspected fraudulent or illegal activity
• At our discretion, with or without cause

Upon termination, your right to use the Service ceases immediately, and we may delete your account and content.

14. Changes to Terms

AUXCON reserves the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AUXCON is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

16. Dispute Resolution

Before filing a lawsuit, you agree to attempt to resolve disputes informally by contacting AUXCON at support@auxcon.app. If informal resolution fails, disputes may be resolved through binding arbitration as provided under applicable law.

17. Miscellaneous

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and AUXCON.
• Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
• Assignment: You may not assign these Terms without our consent. AUXCON may assign these Terms at any time.
